1. Agreement to Terms

By accessing our website and utilizing our appraisal services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with any part of these terms, you are prohibited from using or accessing this site and our services.

2. Services Provided

Action Valuation Services provides professional real estate appraisal services in South Florida. All appraisals are conducted in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP) and applicable state and federal regulations. The specific scope of work, intended use, and intended users will be defined in a separate engagement letter or agreement for each assignment.

3. Intellectual Property Rights

Unless otherwise indicated, the website and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site are owned or controlled by us and are protected by copyright and trademark laws. Appraisal reports and their contents remain the intellectual property of Action Valuation Services, subject to the rights of the client as defined by USPAP and the specific engagement agreement.

4. User Representations

By using the site or our services, you represent and warrant that: (1) all information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update it as necessary; and (3) you will not use the site for any illegal or unauthorized purpose.

5. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or reliance on any information provided on the site. Liability related to specific appraisal assignments is governed by the terms of the individual engagement agreement.

6. Governing Law

These Terms shall be governed by and defined following the laws of the State of Florida. Action Valuation Services and yourself irrevocably consent that the courts of Florida shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
